Terms of Service
These Terms of Service ("Terms") apply to your use of CoachToFit, operated by Sur Haus, Inc. ("CoachToFit," "we," "us"), including the mobile app, the coaching dashboard, and coachtofit websites (together, the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
1. The Service
CoachToFit is a peer-supported weight-management program for Veterans, supported by the U.S. Department of Veterans Affairs (VA). Participants use the app to track steps and weight, set goals, and work through learning chapters, and they meet regularly with a VA peer specialist coach. Coaches and administrators use the dashboard to support participants. Features may change over time.
2. Not medical advice
CoachToFit supports healthy habits. It is not a medical service, doesn't diagnose or treat any condition, and doesn't replace your doctor or mental health provider. Peer coaches are not clinicians. Talk with your health care team before changing your diet, exercise, or medications, and stop any activity that causes pain, dizziness, or shortness of breath. The Service is not monitored around the clock, so don't use it to report urgent health or safety concerns.
3. Eligibility and accounts
- You must be 18 or older and enrolled by a CoachToFit program site, or authorized as a coach or administrator.
- Keep your sign-in details private. You're responsible for activity on your account, so tell your coach or contact us right away if you think someone else has accessed it.
- Give accurate information so your coach can support you well.
4. Acceptable use
Please don't:
- access another person's account or data without authorization;
- interfere with, probe, or disrupt the Service or its security;
- copy, reverse-engineer, or resell the Service or its content;
- use the Service for anything unlawful, harassing, or harmful.
Coaches and administrators may use participant information only to deliver and run the program, as authorized and in line with VA privacy and security policies and applicable law.
5. Your content
The entries you add, such as steps, weigh-ins, goals, and reflections, remain yours. You allow us to store and use them to run the program as described in our Privacy Policy.
6. Our content
The Service, including its software, curriculum, and design, is owned by CoachToFit and its partners and licensors. We give you a personal, non-transferable permission to use it for taking part in or delivering the program.
7. Devices and third-party services
The Service can connect to Apple Health, Health Connect, fitness trackers, and scales. Those products are governed by their makers' own terms and privacy policies. We aren't responsible for their accuracy or availability. Standard mobile data charges may apply.
8. Leaving or suspension
You can stop participating at any time by telling your coach or contacting us. We may suspend or end access if these Terms are violated, if your enrollment ends, or if we need to protect the Service or other users. What happens to your data afterward is covered in our Privacy Policy.
9. Disclaimers and limits of liability
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we don't guarantee that it will be uninterrupted, error-free, or produce any particular result, including weight loss. To the fullest extent permitted by law, CoachToFit and its partners are not liable for indirect, incidental, or consequential damages that arise from your use of the Service. Nothing in these Terms limits any rights you have that cannot be limited by law.
10. Governing law
These Terms are governed by the federal laws of the United States, without regard to conflict-of-law rules.
11. Changes to these Terms
We may update these Terms. When we do, we'll change the date above, and if the change is significant we'll tell you in the app or through your coach before it takes effect. If you keep using the Service after that, you accept the updated Terms.
